INFORMATION ON THE PROCESSING AND PROTECTION OF PERSONAL DATA

Within its activities, EOS KSI Romania SRL, having its headquarters in Bucharest, 10A Dimitrie Pompei Blvd., building C3, 7th floor, sector 2, registered at the Trade Office under no. J40 / 13219/2002, with unique registration code 15089252, fiscal attribute RO ("EOS KSI"), debt collection entity registered in the register of the receivables collection entities which is registered at the National Authority for Consumers Protection, and registered by the National Supervisory Authority for Personal Data Processing, processes your personal data.

INFORMATION ON THE PROCESSING AND PROTECTION OF PERSONAL DATA IN THE CALL CENTER ACTIVITY

INFORMATION NOTE on the processing of personal data at the Company's headquarters in view of limiting access to the headquarters in the context of COVID-19​​​​​​​

If you are a debtor or guarantor of the receivables managed by EOS KSI: 

  • Identifying or contact data such as: name, date of birth, nationality, personal identification number (CNP), place of birth, identity card data (if applicable), domicile, home or correspondence address; 
  • Data about your financial or employment situation, such as the employer's name, income and the source of income; 
  • Data on administrative or judicial proceedings, insofar as they relate to receivables managed or owned by EOS KSI; 
  • Record of the interactions between you and EOS KSI, if necessary, through EOS KSI call center or other correspondence or communications between you and EOS KSI; 
  • Payment data, including details of your bank account and other related information; 
  • Other personal data mentioned in the debt or guarantee documentation or mentioned in the initial contract.
If you make payments or act as the contact person for a debtor or guarantor of the receivables managed by EOS KSI or you have a connection with, or you can provide information about, these persons:

  • Identifying or contact data such as your name, domicile, address of residence or mailing address, telephone number, e-mail address;
  • If you make payments on behalf of a debtor or guarantor, data related to respective payments, including personal identification number (CNP), details of the bank account and other related data;
  • Recording of the interactions between you and EOS KSI, if necessary, through the EOS KSI call center or other correspondence or communications between you and EOS KSI;
  • Other data provided directly by you or other people who have indicated you as your contact person or providing details about you based on a legitimate interest.
If you are an employee, collaborator, representative or contact person of a customer, vendor or other business partner of EOS KSI:

  • Identification or contact data such as your name, business address or home address, job title, phone number, e-mail address; 
  • Recording of the interactions between you and EOS KSI, if necessary, through the EOS KSI call center or other correspondence or communications between you and EOS KSI.
In limited situations, when required by law, the data in the ID card, including personal identification number (CNP), place of birth, data related to political opinions or trade union membership.

When you retrieve our website the browser used on your device automatically sends information to our website’s server(tehnical information about your visit on the website). 
If you are the debtor or guarantor of the claims managed by EOS KSI, in accordance with the applicable legal provisions, we may collect data about you from:

  • Lenders (such as banking and non-banking financial institutions, telephone companies, service companies, etc.) that empowers EOS KSI to carry out the activity of collection and management of their debts or from creditors who alienate their claims to EOS KSI;
  • Directly from you (or, in some cases, from other persons that justify a legitimate interest related to the contract in connection with which we carry out the activity of debt collection);
  • Persons authorized to communicate with us on your behalf or persons who make  payments on your behalf;
  • Authorities and public institutions or other persons or entities that carry out a service of public interest (such as bailiffs or public notaries);
  • Publications and databases that are available publicly or contractually.
If you make payments or act as the contact person for a debtor or guarantor of the receivables managed by EOS KSI or you have a connection with, or you can provide information about these people, we may collect data about you from the following sources:

  • Creditors who empower EOS KSI to conduct their debt recovery and management or creditors who settle receivables with EOS KSI, to the extent that your data is part of the documentation on that claim;
  • Directly from you (or, in some cases, from other persons authorized to communicate with us on your behalf or that justify a legitimate interest in the contract for which we perform the debt recovery activity);
  • Authorities and public institutions or publications and databases that are publicly or contractually available.
If you are an employee, collaborator, representative, or contact person of a customer, vendor or other business partner of EOS KSI, we may collect data about you from the following sources:

  • Directly from you or from persons acting on behalf of the customer, supplier or business partner of EOS KSI;
  • Authorities and public institutions or publications and databases that are publicly or contractually available.
If you visit us at our headquarters or at our local offices or if you write or call us on various inquiries or issues of interest to you, we can collect your name and contact details as well as other personal data on which you provide us directly.

When you retrieve our website the browser used on your device automatically sends information to our website’s server. This information is temporarily saved in a log file. The following information is collected without your intervention and saved until it is automatically deleted after three (3) days:

  • IP address of retrieving computer,
  • date and time of access,
  • name and URL of retrieved file,
  • website from which access occurred (referrer URL),
  • website retrieved from our website,
  • your computer’s browser and possibly operating system as well as name of your access provider.
Beyond that we use cookies and analysis services when you visit our website. More detailed information below in the cookies section.
EOS KSI can process your personal data:

  • For collecting receivables managed or owned by EOS KSI;
  • For the purpose of communicating with debtors or guarantors of receivables administered by EOS KSI, to the extent that you are a contact person or have a connection with, or you can provide information about those persons;
  • For the purpose of executing a contract or managing a business relationship between EOS KSI and a customer, vendor or other business partner, if you are an employee, collaborator, representative or contact person of that respective customer, vendor or partner;
  • To respond to your requests or public authorities or to meet legal requirements;
  • Subject to the conditions set forth by law, for the prevention or investigation of fraud or for the purpose of criminal proceedings related to receivables managed or held by EOS KSI, as well as for the defense or exercise of our rights under the law;
  • For the internal management of EOS KSI and its affiliated companies with regard to debt collection services, including audit, quality control, archiving and security of premises, assets and staff of EOS KSI and its affiliated companies.
  • Online data :

    • to ensure trouble-free connection establishment to the website,
    • to ensure comfortable use of our website,
    • to analyse the system security and stability, and
    • for other administrative purposes.
  • The legitimate interest of EOS KSI, its affiliated companies or creditors on behalf of which EOS KSI provides receivables management or debt collection services, to collect outstanding debts and manage its activities in the collection process;
  • The legitimate interest of EOS KSI in documenting contract execution and managing a business relationship with a customer, vendor, or other business partner, and in managing its internal activities and processes, if you are an employee, collaborator, representative or contact person of the respective client, vendor or partner;
  • The legitimate interest in defending or exercising the rights of EOS KSI and its affiliated companies under the law, including ensuring the security of their premises, assets and their personnel;
  • Your consent, if you act as the contact person for a debtor or guarantor of the claims managed by EOS KSI or you have a connection with, or you can provide information on these persons, as well as in other cases to the extent that the processing data by EOS KSI requires your consent under the law;
  • Compliance with a legal obligation under EOS KSI (e.g. consumer protection, tax legislation or legislation regarding prevention of money laundering and financing of terrorist acts).
  • The legal basis for processing of the data is Art. 6(1) Sent. 1 (f) of the GDPR. Our legitimate interest follows from the purposes for data collection listed about providing online website acces.
EOS KSI may transfer your data to other persons or entities that provide services or perform operations in the normal course of the debt collection activity or during the normal course of EOS KSI management activity.

EOS KSI may also use or disclose personal data when it is necessary (when it has a legal obligation) or law allows to do so. EOS KSI will not allow the access or transfer of personal data to any natural or legal person that is not established in the European Union.

The categories of people to whom EOS KSI may transfer personal data include:

  • Creditors on behalf of which EOS KSI provides receivables management or debt collection services or assignors from which EOS KSI has acquired receivables owed or guaranteed by you;
  • Public authorities, to meet legal requirements.
In the debt collection activities, EOS KSI will retain your personal data throughout the collection process of a debt and five years after the full debt is fully collected, unless the law otherwise provides. 

In other activities than debt collection, EOS KSI will process your data for as long as it is necessary to achieve the purpose for which this data was collected for or, if processing is based on consent, until your consent is withdrawn, unless the law provides another period of data retention or retention of data is required to exercise or defend the rights of EOS KSI or its affiliated companies.
  • You may request access to your personal data owned by EOS KSI and also rectification of such data, to the extent that you consider it inaccurate. If the processing is based on consent or on a contract between you and EOS KSI, you may request us to send your data in a structured format that is currently in use and that can be read automatically or require us to send your data to another operator.
  • You can also withdraw your consent at any time (if data processing is based on consent), oppose the processing of your personal data, or request the deletion of such data, as well as request restriction of your data processing;
  • EOS KSI may request additional information necessary to confirm your identity before granting you access to your personal data or acting in connection with the exercise of your previously mentioned rights;
  • Please note that in justified cases EOS KSI is legally allowed to refuse to act as above, in which case EOS KSI will provide you with a written explanation of this refusal;
